Terms and Conditions

We supply consumers as well as businesses, including upholsterers, furniture manufacturers, healthcare manufacturers and other trade customers.

A consumer is an individual purchasing wholly or mainly for purposes outside their trade, business, craft or profession.

A trade customer is a person, partnership, company or other organisation purchasing for business purposes.

You may use this website only for lawful purposes. You must not use it in a way that damages the website, interferes with its operation, attempts to gain unauthorised access or infringes the rights of another person.

We may suspend, restrict or withdraw access where we reasonably believe the website is being misused or where maintenance, security or operational work is required.

We do not guarantee that the website will always be available, uninterrupted or free from technical errors.

We supply polyurethane foam, reconstituted foam, memory foam, upholstery materials, fillings, adhesives, cut-to-size products and bespoke manufactured components.

• check Product descriptions, colours and images are provided as accurately as reasonably possible.
• check Minor colour, texture, cell-structure, density and dimensional variations may occur within normal manufacturing tolerances.
• check All products remain subject to stock, material and production availability.
• check Customers are responsible for checking that their chosen material is suitable for their intended application.

Adhesives, aerosols and other regulated products must be stored, handled and used in accordance with the manufacturer’s instructions, safety data sheet and applicable health and safety requirements.

You are responsible for checking all measurements, drawings, templates, foam grades, quantities and specifications before submitting an order.

Where we manufacture or cut goods using information supplied by you, we will rely on that information being complete and accurate.

Placing an order is an offer to purchase the selected goods subject to these Terms and Conditions.

An automated order acknowledgement confirms that we have received your order. It does not necessarily mean that the order has been accepted.

Unless we tell you otherwise, the contract is formed when we send confirmation that the order has been accepted or when the goods are dispatched, whichever occurs first.

Stock information shown on our website is updated regularly but is not guaranteed to be real-time. On rare occasions, an item shown as available may have sold or otherwise become unavailable before our website stock records are updated.

If an item becomes unavailable after you have placed an order, we will contact you as soon as reasonably possible. Where appropriate, we may offer an estimated restocking date, a suitable alternative, or a refund for the affected item.

We may decline or cancel an order where products are unavailable, the price or description contains an obvious error, payment is not authorised, delivery is unavailable or fraud or security concerns arise.

Please contact us immediately if you need to amend or cancel an order. We cannot guarantee that a request can be accepted once production, cutting, processing, packing or dispatch has started.

Consumer cancellation rights for eligible distance orders continue to apply in accordance with applicable law and our Returns Policy.

Business customers do not automatically receive consumer cancellation rights. Any cancellation accepted for a trade order may be subject to reasonable costs already incurred.

Prices are displayed in pounds sterling. VAT will be included or added as shown during checkout and on the order summary.

Delivery charges and other applicable costs will be displayed before the order is submitted wherever they can be calculated online.

We may change prices at any time, but this will not normally affect an order that has already been accepted.

From time to time we may offer promotional prices, discount codes, vouchers or other special offers. Unless expressly stated otherwise, discounts and promotional offers cannot be combined with one another.

Where a customer already receives an agreed account or trade discount and also enters a promotional discount code, discounts will not normally be applied cumulatively. The customer will receive the higher applicable discount for the affected product or order.

Promotional codes may be subject to minimum order values, product or category exclusions, expiry dates, usage limits, customer eligibility requirements or other conditions stated with the promotion.

Unless expressly stated otherwise, promotional discounts do not apply to delivery charges, bespoke quotations, specially negotiated prices or products already subject to a greater account or trade discount.

We reserve the right to withdraw, amend or refuse a promotional offer where the stated conditions have not been met, where a code has been used improperly, or where an obvious technical or pricing error has occurred.

If an obvious pricing, calculation or description error is identified, we may contact you for instructions or cancel the affected order and refund any amount already paid.

Payments may be processed by Stripe, PayPal or another payment provider shown during checkout. Payment remains subject to authorisation, authentication and fraud-prevention checks.

We deliver throughout the UK and may offer selected international delivery services where agreed. Availability depends on the products, order size, destination and available carrier services.

Delivery dates and lead times are estimates unless we have expressly agreed a guaranteed delivery date in writing.

We are not responsible for delays caused by events outside our reasonable control, although this does not remove any legal rights available to consumers.

For consumer orders, risk normally passes when the goods come into the physical possession of the consumer or a person identified by the consumer to receive them.

For trade orders, risk normally passes on delivery to the agreed delivery location unless otherwise agreed in writing.

Do not travel to collect an order until we have confirmed that it is complete and ready.

We may request the order number, collection confirmation and proof of identity before releasing the goods.

Customers are responsible for providing a vehicle that is suitable for the dimensions, quantity and weight of the goods being collected.

Risk passes to the customer when the goods are handed over at the collection point.

Returns and cancellations are governed by our Returns Policy, which forms part of these Terms and Conditions.

Consumers purchasing eligible standard goods online normally have 14 days after receiving the goods to tell us they wish to cancel. A further 14 days is normally allowed to return the goods.

This change-of-mind cancellation right does not normally apply to goods made to the customer’s specifications or clearly personalised, including cut-to-size and bespoke foam products.

These exclusions do not affect legal rights where goods are faulty, damaged, incorrect or not as described.

Please inspect the goods as soon as reasonably possible after delivery and contact us promptly if anything is faulty, damaged, incorrect or materially different from its description.

We may ask for photographs, measurements, packaging information, batch details or other reasonable evidence so that we can investigate.

Please retain the goods and packaging until we provide instructions. Do not dispose of, alter or return disputed goods without first contacting us.

Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

Nothing in these terms excludes or restricts the statutory rights of consumers.

For trade customers only, and to the fullest extent permitted by law, we will not be liable for indirect or consequential losses, loss of profit, loss of business, loss of anticipated savings or loss of business opportunity.

Any limitation applicable to a trade transaction will be subject to applicable law and any separately agreed written terms.

Unless stated otherwise, the website design, text, photographs, graphics, product information, videos, calculators and other content are owned by or licensed to Cushion Manufacturing Supplies Ltd.

Content may not be copied, republished, distributed, modified or used commercially without our prior written permission, except where permitted by law.

Trade marks, company names and third-party materials remain the property of their respective owners.

We process personal information in accordance with our Privacy Policy and applicable data-protection law.

Information may be used to operate customer accounts, process payments, manufacture products, fulfil deliveries, prevent fraud and provide customer support.

We will not be responsible for delay or failure caused by an event outside our reasonable control.

This may include severe weather, transport disruption, fire, flood, power failure, machinery breakdown, industrial action, supplier failure, material shortages, epidemic, government restriction or courier disruption.

We will take reasonable steps to reduce the effect of the event and will contact affected customers where reasonably practicable.

We may update these Terms and Conditions to reflect changes in our business, website, products, payment services or applicable law.

The version applying to an order will normally be the version published when the order was placed, unless a change is required by law.

Material changes will be published on this page with an updated revision date.

These Terms and Conditions and any contract between us are governed by the laws of England and Wales.

For business customers, the courts of England and Wales will have exclusive jurisdiction unless otherwise agreed in writing.

If you are a consumer, you may also benefit from mandatory legal protections available in the part of the United Kingdom or other jurisdiction in which you live. Nothing in these terms removes those protections or any right to bring proceedings in a court available to you under applicable law.
